LU 17-0028: Boones Ferry Road Nonconformities - Code Amendements

Project Description

The City is completing the final design for Phase 1 of the Boones Ferry Road (BFR) improvements with construction to begin in 2018. The project will affect 50 properties in the Lake Grove Village Center (LGVC) Overlay District by removing some landscaping and/or parking along their frontages. To minimize complications for property owners and to facilitate replacement of commercial parking lost as a result of the transportation project, the City has offered to:

1.  Help replace lost parking on eight specific sites located at:

  • Mozena Law Office (15835 BFR)
  • Naomi’s Lampshades (19510/19532/19542 BFR)
  • Gubanc’s (16008 BFR)
  • Riccardo’s Ristorante (16035/16045 BFR)
  • Keller Williams Realty (16365 BFR)
  • Jenike Property: Andy Paris Surveyors and Kumon (16055/16067 BFR)
  • US Bank (16480 BFR)
  • Bank of America (16209 Bryant Road)

The map (upper right corner) shows the scope of Phase 1, as well as the five specific properties marked in yellow where replacement parking may not fully comply with code (See Attachment 2).

 

2.  Amend City code (LGVC Overlay) to allow area lost to right-of-way dedication for the BFR Project to count towards meeting minimum parking and/or landscaping requirements, subject to limitations, when a site redevelops.

Updates

09/12/17

At its meeting on September 11th, the Planning Commission adopted the Findings, Conclusion and Order (the final recommendation).  A link to the adopted Findings is available below under "Key Documents."

The City Council is scheduled to hold a public hearing October 3, 2017.

The Planning Commission considered the proposed amendments at a public hearing on August 28, 2017, and made a preliminary recommendation that the City Council approve the proposed amendments as written in the staff report and discussed during deliberations.

The Findings, Conclusions and Order (the final recommendation) will be considered on September 11, 2017.

At the Planning Commission public hearing on Monday, August 14th, staff requested that the hearing be opened and immediately continued to Monday, August 28th.  The continuation was requested as a result of field work and additional information requested by the Planning Commission.

Planning Commission Work Session - June 26, 2017

The Planning Commission accepted written comments on the Public Review Draft from May 22, 2017 until 12:00 pm on Friday, June 9, 2017.  At this work session the Planning Commission reviewed comments received on the Public Review Draft and made recommendations to staff for revisions prior to finalizing the amendments for the public hearing. The public hearing before the Planning Commission is tentatively scheduled for August 14, 2017 and the City Council public hearing is expected to be scheduled in the fall.

Notice of Limitations about Materials Posted on Land Use Project Pages

The Case File Materials posted under the designated Planning Division’s Land Use Project Pages and links are:

  • For the convenience of the community and are not the official version;
  • Posted on a periodic (not daily) basis. Typically, materials are not posted until the deadline for submission has passed, in order to post all materials relating to the same deadline at the same time.
  • Materials the Project Manager has designated at the time of posting to be included in the Record before the reviewing authority– the entire contents of the Planning Division’s Case File are NOT posted.

-  There are additional materials in the Case File that the Project Manager believes are NOT for the purpose of addressing whether the proposed development application complies with the applicable criteria. These additional materials are NOT posted. (Only materials identified by the applicant or interested parties for the purpose of addressing the applicable criteria are made a part of the “record” before the reviewing authority.)

The Planning Division’s Case File may be viewed by the public Monday - Friday, excluding holidays, 8 A.M. to 4:30 P.M. in the Planning and Building Services Department. Persons are encouraged to contact the Project Manager to arrange for a suitable location to review the materials in the Case File.

Note: Materials exempt under the Oregon Public Records Law, ORS 192.501 and 192.502 may be withheld from public review of the Case File; such materials are NOT a part of the “record” before the reviewing authority in determining whether or not the proposed development complies with the applicable criteria.
